We offer this website, including all information, tools and services available on it, on the condition that you accept these Terms of Service ("Terms") and the policies referred to in them. By visiting our site and/or purchasing from us, you use our "Service" and agree to be bound by these Terms. They apply to all users of the site, including visitors, customers and people who submit reviews or comments.

Please read these Terms carefully before using the website or placing an order. Our online store is hosted on Shopify Inc.

Section 1 – Online store terms

By accepting these Terms, you confirm that you are at least 18 years old, or the age of majority in your country, state or province of residence if that is higher.

You may not use our products or the Service for any illegal or unauthorised purpose, breach any applicable law, or transmit any malicious code. If you breach any of these Terms, we may immediately suspend or terminate your access to the Service.

Section 2 – General conditions

We may refuse Service to anyone for legitimate reasons, such as suspected fraud, abuse or breach of these Terms. Payment card data is always encrypted during transfer and is processed by our payment providers.

You may not reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our prior written permission.

Section 3 – Accuracy of information

The information on this site is provided for general information only. We make reasonable efforts to keep it accurate, complete and up to date, but we may correct or update content at any time. Nothing on this site constitutes medical advice.

Section 4 – Prices and changes to the Service

All prices are shown in [EUR/USD] and include VAT where applicable. Shipping costs, if any, are shown separately at checkout before you confirm your order. For orders shipped outside the European Union, import duties and local taxes may apply and are payable by the customer, unless otherwise stated at checkout.

We may change prices at any time. Changes do not affect orders already placed. When we advertise a price reduction, the reference price is the lowest price applied in the 30 days before the reduction, in accordance with Article 17-bis of the Italian Consumer Code.

We may modify or discontinue the Service, or any part of it, at any time.

Section 5 – Products

5.1 Nature of our products

Our products are cosmetic products within the meaning of Regulation (EC) No 1223/2009. They are not medicines or medical devices. They are not intended to diagnose, treat, cure or prevent any disease, and they do not replace advice from a doctor or other healthcare professional.

5.2 Results

Product descriptions, before-and-after images and customer testimonials reflect individual experiences. Results vary from person to person depending on skin type, age, lifestyle and consistency of use. We do not guarantee any specific result.

5.3 Safe use

Before first use, please read the full list of ingredients on the product page and packaging. We recommend carrying out a patch test on a small area of skin 24 hours before full use. Stop using the product if irritation occurs, and consult a doctor if it persists. If you are pregnant, breastfeeding, undergoing medical or dermatological treatment, or have known allergies or sensitive skin, consult your doctor before use. For external use only. Avoid contact with the eyes. Keep out of reach of children.

5.4 Images and availability

We make every effort to display product colours and images accurately, but we cannot guarantee that your screen will show colours exactly. Some products may be available only online or in limited quantities. We may limit quantities per person, household or order.

Section 6 – Orders and payment

6.1 How the contract is formed

The product pages on our site are an invitation to make an offer. When you place an order, you make an offer to buy the products. You will receive an automatic email confirming that we have received your order. The contract is formed when we send you the order confirmation email, or, at the latest, when we ship the products.

6.2 Refusal and cancellation of orders

We may refuse or cancel an order, for example where a product is unavailable, the price or description contains an obvious error, or we suspect fraud. If this happens after you have paid, we will refund you in full without delay.

6.3 Payment methods

We accept the payment methods shown at checkout, including [credit and debit cards, PayPal, Apple Pay, Google Pay, Shop Pay]. Payment is charged when you place the order.

6.4 Accuracy of your information

You agree to provide current, complete and accurate information for every purchase, and to update it promptly if it changes.

Section 7 – Shipping and delivery

Risk of loss of or damage to the products passes to you when you, or a person you designate (other than the carrier), take physical possession of them. When you receive the parcel, please check that the packaging is intact. If it is damaged, accept it with reservation or contact us within [7] days with photos.

Section 8 – Right of withdrawal (EU and UK consumers)

8.1 Your right

If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party you designate (other than the carrier), take physical possession of the products. If you order several products delivered separately, the period runs from receipt of the last product.

8.2 How to withdraw

To exercise the right of withdrawal, send us a clear statement of your decision, by email to info@aureacosmetic.it or by post to the address above, before the withdrawal period expires. You may use the model withdrawal form below, but you do not have to.

8.3 Exception for unsealed products

In accordance with Article 59(1)(e) of the Italian Consumer Code, the right of withdrawal does not apply to sealed products that are not suitable for return for health protection or hygiene reasons once they have been unsealed after delivery. Our creams and skincare products are delivered with a protective seal. If the seal has been removed or broken, the right of withdrawal no longer applies to that product. This does not affect your rights under the legal guarantee (Section 10) or any voluntary guarantee we offer (Section 9).

8.4 Returning the products

You must send back the products, unused and with the seal intact, without undue delay and in any event within 14 days of telling us that you are withdrawing. Return them to: [return address]. You bear the direct cost of returning the products [unless otherwise stated].

8.5 Refunds

We will refund all payments received from you, including standard delivery costs, within 14 days of receiving your withdrawal notice. We will not refund extra costs if you chose a delivery method more expensive than the standard one. We may withhold the refund until we have received the products back, or until you have supplied proof of having sent them back, whichever is earlier. We will use the same payment method you used for the original transaction, unless you expressly agree otherwise, and you will not pay any fees for the refund.

You are liable for any loss in value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Section 9 – Satisfaction guarantee [only if you offer one]

In addition to your legal rights, we offer a voluntary [60]-day satisfaction guarantee on [product name / all products].

If you are not satisfied with the results, contact us at info@aureacosmetic.it within [60] days of delivery, giving your order number. We will refund [the full purchase price / the price of one unit per customer], excluding shipping costs, within 14 days of approving your request.

Conditions:

Section 10 – Legal guarantee of conformity

If you are a consumer in the EU, you are entitled to the legal guarantee of conformity under Articles 128–135-septies of the Italian Consumer Code. We are liable for any lack of conformity that becomes apparent within 2 years of delivery.

If a product is defective, damaged, or not as described, contact us at info@aureacosmetic.it, describing the problem and attaching photos. You will be entitled to have the product replaced free of charge or, where that is not possible, to a price reduction or a refund.

Section 11 – Optional tools

We may give you access to third-party tools that we neither monitor nor control. You use them at your own risk, and their use is governed by the terms of the relevant third-party providers.

Section 12 – Third-party links

Our site may contain links to third-party websites. We are not responsible for their content, products, services or privacy practices.

Section 13 – Reviews, comments and other submissions

If you submit reviews, comments, photos or other material, you grant us a non-exclusive, royalty-free licence to use, reproduce, edit and publish that material in connection with our business, including on our website and social media. Where we use your name or image in advertising, we will ask for your separate consent.

You agree that your submissions will be truthful, will reflect your genuine experience, and will not be unlawful, offensive, or infringe third-party rights.

How we handle reviews. [Reviews marked "Verified buyer" come from customers who have purchased the product, as checked against our order records.] We publish both positive and negative reviews, and we do not pay for reviews or edit their content, except to remove material that is unlawful, offensive or unrelated to the product. Section 15 – Errors, inaccuracies and omissions

If an order was placed at an obviously wrong price, we will contact you before shipping and you can choose whether to confirm the order at the correct price or cancel it and receive a full refund.

You may not use the site or its content to:

• infringe our intellectual property rights or those of others;
• harass, insult, defame or discriminate against others;
• submit false or misleading information, including fake reviews;
• upload or transmit viruses or malicious code;
• collect or track other users' personal data;
• send spam, phish, scrape or crawl the site;
• interfere with or circumvent the security features of the Service.

Section 17 – Disclaimer of warranties; limitation of liability

We do not guarantee that the Service will be uninterrupted, timely, secure or error-free.

To the extent permitted by law, Giarrizzo Sales S.r.l.s. and its directors, employees and contributors are not liable for any indirect, incidental or consequential damages arising from use of the Service.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, for gross negligence, for defective products under Articles 114 et seq. of the Italian Consumer Code, or for any other liability that cannot be limited or excluded by law. This section does not affect the mandatory rights of consumers.

Section 18 – Indemnification

You agree to indemnify and hold harmless Giarrizzo Sales S.r.l.s., its directors, employees and contributors from any claim or demand made by third parties that arises from your breach of these Terms or your violation of any law or third-party rights.

Section 19 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain valid and effective.

Section 20 – Termination

These Terms remain effective until terminated by you or by us. You may terminate them at any time by ceasing to use the Service. Obligations and liabilities incurred before termination survive it.

Section 21 – Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, [Shipping Policy and Refund Policy] and any other policies published on this site, constitute the entire agreement between you and us regarding use of the Service.

Section 22 – Governing law and jurisdiction

These Terms are governed by Italian law.

EU and UK consumers. If you are a consumer resident in another country, you also benefit from any mandatory provisions of the law of your country of residence.

Consumers in Italy. Under Article 66-bis of the Italian Consumer Code, the courts of your place of residence or domicile in Italy have exclusive jurisdiction.

Consumers in other EU countries. You may bring proceedings before the courts of your country of residence.

Business customers (B2B). For business-to-business relationships, the Court of Catania has exclusive jurisdiction.

Out-of-court dispute resolution. You may also use alternative dispute resolution (ADR) procedures, such as consumer mediation bodies recognised under Articles 141 et seq. of the Italian Consumer Code. Before doing so, we encourage you to contact us at info@aureacosmetic.it so that we can try to resolve the issue directly.

Section 23 – Changes to these Terms

We may update these Terms by posting a new version on this page and changing the "Last updated" date. Each order is governed by the version of the Terms in force when the order was placed. Your continued use of the site after changes are posted constitutes acceptance of the new version for future use and orders.
